End User License Agreement

YourMyDS Software Terms of Service

THIS SOFTWARE LICENSE AND SERVICES AGREEMENT (the "Agreement") is entered into by and between YourMyDS ("Licensor") and the end user or entity accessing the Software ("End User"). This Agreement governs the End User's use of the YourMyDS software, associated data analytics tools, and related services (collectively, the "Software"). By accessing, or using the Software, the End User agrees to the terms of this Agreement.

1. ORDERING AND SUBSCRIPTION PERIOD

1.1 Ordering:

By signing up for a YourMyDS account or executing an subscription form, End User may access market intelligence and data analytics software. All use of the Software is subject to this Agreement and applicable order forms.

1.2 Fees and Payment Terms:

  • All fees are covered in the applicable subscription form or pricing page.
  • Payment is due upon receipt of the invoice unless otherwise agreed upon.
  • Payments are non-refundable unless otherwise stated in this Agreement.

1.3 Subscription Renewal:

  • Subscriptions automatically renew unless canceled before the current billing period ends.
  • Any upgrades will take effect immediately, with corresponding charges applied.

2. LICENSE AND USE RESTRICTIONS

2.1 License Grant:

YourMyDS grants End User a limited, non-exclusive, non-transferable license to access and use the Software for:

  • Statistics Tools
  • Trading strategy tools
  • Data visualization tools
  • other tools available on YourMyDS’ web.

2.2 Restrictions:

  • End User may not reverse engineer, decompile, or disassemble the Software.
  • End User may not resell, sublicense, or distribute the Software without written consent.
  • End User must not use the Software violating any applicable laws or regulations.

2.3 Account Registration:

End Users must provide accurate information when creating an account and are responsible for safeguarding login credentials.

3. DATA USAGE AND INTELLECTUAL PROPERTY

3.1 Ownership:

All intellectual property rights in the Software remain the exclusive property of YourMyDS. No rights are granted except as explicitly stated in this Agreement. Data provided in YourMyDS are from vendors based on the Data Services Agreement with the vendor.

3.2 Data License:

Subject to the terms herein, YourMyDS grants the End User a license to access and utilize data provided by the Software for personal use and academic purposes. End users shall not at any time, directly, or indirectly: copy, rent, lease, sell, sublicense, assign, distribute, publish, transfer or make available the raw data to public or other party (ies) without permission of YourMyDS. In processing data, End Users can export the raw data to be analyzed for personal and or academic purposes.

3.3. Publication of processed data from Your MIDAS:

End Users can post tables or charts of the processed data on their social media and/or academic works, including academic journals, proceedings, and books.

3.4. Commercial Use:

End Users cannot use the data from YourMyDS for commercial use. For the purposes of these terms of service, "Commercial Use" refers to, but is not limited to, the following activities:

Association with Business or Commercial Entities: Any association with a company, organization, or non-personal domain, including but not limited to being an employee, contractor, representative, or having any affiliation suggesting a connection with a business or commercial entity.

Data Collection and Analysis for Commercial Purposes: Collecting, aggregating, or analyzing data using YourMyDS Services or Data for commercial purposes or to support commercial activities, including market research, business intelligence, or data-driven decision-making.

3.5 End User Data:

  • End User who uploads the data retains ownership of all data they input into the Software.
  • End User grants YourMyDS a non-exclusive, worldwide license to use such data to improve the Software.

4. SUPPORT AND MAINTENANCE

4.1 YourMyDS will provide support as outlined in YourMyDS’s website. Updates or enhancements may be provided at Licensor's discretion.

5. CONFIDENTIALITY

5.1 Each party agrees to protect the other’s Confidential Information and use it only as permitted under this Agreement. "Confidential Information" includes any non-public business, technical, or financial information disclosed under this Agreement.

6. TERMINATION

6.1 For Cause: Either party may terminate this Agreement if the other party materially breaches its terms and fails to remedy such breach within 30 days of receiving written notice.

6.2 Effect of Termination: Upon termination, End User must cease all use of the Software and delete all copies in their possession.

7. LIMITATION OF LIABILITY

7.1 The Software is provided "AS IS" without warranties of any kind, express or implied.

7.2 YourMyDS’ total liability under this Agreement is limited to the amount paid by the End User according to End User’s paid subscription form.

8. GOVERNING LAW

This Agreement shall be governed by the laws of Indonesia. Any disputes shall be resolved exclusively in the courts located in Indonesia.

9. MISCELLANEOUS

9.1 Entire Agreement: This Agreement constitutes the entire agreement between the parties.

9.2 Modifications: YourMyDS reserves the right to update this Agreement. Continued use of the Software constitutes acceptance of such changes.

9.3 Severability: If any provision is found unenforceable, the remaining terms shall remain in full force.

9.4 Notices: All notices under this Agreement must be sent to YourMyDS at [email protected].

9.5. Risk of software usage: YourMyDS shall not be liable for any damages or losses, including but not limited to hardware damage, data loss, or business interruption, arising from the use or inability to use the Software. The user is solely responsible for the protection and backup of their data and hardware used to run the YourMyDS Software.

9.6. Risk of data usage: The use of the data and services provided by YourMyDS is subject to the terms and conditions outlined in our Terms of Service. The financial information and data provided are intended solely for informational purposes and should not be considered as advice or recommendations for trading, investment, legal, tax, accounting, or other professional services. Users access and utilize this data at their own risk. YourMyDS disclaims any liability for inaccuracies or errors in the provided data.
